Hawaii attorneys have the right to send targeted direct mail solicitations. HAWAII RULE OF PROFESSIONAL CONDUCT 7.2 (a) states "Subject to the requirements of Rules 7.1 and 7.3, a lawyer may advertise services through public media, such as a telephone directory, legal directory, newspaper or other periodical, outdoor advertising, radio, or television, or through written or recorded communication"

General information regarding the content of a letter

  • No false or misleading claims
HAWAII RULE OF PROFESSIONAL CONDUCT 7.3
  • No future communication if person requests communications stop
  • No coercion, duress or harassment
HAWAII RULE OF PROFESSIONAL CONDUCT 7.4
  • May communicate fields of practice
  • May not state certification

Specific information regarding the content of a letter

HAWAII RULE OF PROFESSIONAL CONDUCT 7.2
  • Any communication made pursuant to this rule shall include the name of at least one lawyer responsible for its content.
HAWAII RULE OF PROFESSIONAL CONDUCT 7.3
  • "Advertising Material" must be placed (1) on the outside envelope and at the top of the first page of the contents of the envelope
  • A sample copy of any written or recorded communication directed by a lawyer to one or more prospective clients for purposes of seeking or recommending employment shall be simultaneously forwarded by the lawyer to the Office of Disciplinary Counsel.
  • No letters sent for personal injury or wrongful death unless the personal injury or wrongful death occurred more than thirty (30) days prior to the sending of the communication
  • No letters sent if the lawyer knows or should know that the physical, emotional, or mental state of the person makes it unlikely that the person would exercise reasonable judgment in employing a lawyer.
  • Written communications to prospective clients shall be sent only by regular U.S. mail, not by registered mail or other forms of restricted delivery, and not by facsimile or e-mail
  • Must disclose how the person's name was acquired
  • Written communications shall not resemble legal pleadings or other legal documents
  • Written communication shall not reveal the nature of the prospective client's legal problem on the outside of the mailing
