General information regarding the content of a letter
Rule 1-400 Advertising and Solicitation
- Letters may not contain any untrue statement
- Letters may not present material in a way that could confuse or mislead the recipient
- Letters may not omit facts that may result in misleading recipient
- Letters must indicate clearly it is a communication for solicitation
- Letters must not intimidate or harass
- Letters Must not state lawyer is a specialist unless attorney holds a certificate issued by the Board of
Legal Specialization or other agency approved by
CA Bar
- Attorneys must retain copy of communication for 2 years and make available to Bar upon request
Prohibited Communiations
Rule 1-400 Advertising and Solicitation
The Board of Governors of the State Bar have indicated the
following communications are prohibited:
- Any communication offering a guaranty, warranty, or prediction
- Any communication with endorsements or testimonials unless it is stated that it is not a guarantee or prediction of the recipient's case
- Any communication to a person who could not be expected to exercise reasonable judgment in retaining an attorney
- Any communication offered at the scene of an accident or
en route to a health care facility
- Any communication that does not bear the words "advertisement", "newsletter", or similar words in 12-point type on the first page and on the envelope
- Any communication that indicates it can provide services
in a language other than English unless the person identified
in the communication can provide such services or the person who
can is clearly identified by name and by whether or not they are
a lawyer

Legal advertising rules must be followed by an attorney
even if they are marketing non-legal services if their status
as an attorney is stated
