General information regarding the content of a letter

DELAWARE RULE OF PROFESSIONAL CONDUCT 7.1
  • A communication is false or misleading if it contains a material misrepresentation or omission of fact
DELAWARE RULE OF PROFESSIONAL CONDUCT 7.4
  • An attorney may only use term specialist if certified by an organization approved by the ABA and that organization is named
DELAWARE RULE OF PROFESSIONAL CONDUCT 7.5
  • Same firm name can be used in different jurisdictions but any jurisdictional limits on attorney must be noted
  • Cannot indication a partnership or other association unless it actually exists

Specific information regarding the content of a letter

DELAWARE RULE OF PROFESSIONAL CONDUCT 7.3(c)
  • All direct mail solicitation shall contain "advertising material" on the outside of the envelope
DELAWARE RULE OF PROFESSIONAL CONDUCT 7.2
    Any communication sent under this rule should contain the name and address of at least one attorney responsible for its content

Delaware Ethics Opinions

Opinion 1993-1
  • This opinion reaffirmed that an attorney may list specific areas of practice
  • Found that stating "Any residential settlement $400 flat fee for attorneys work" did not comply with Rule 7.1 because it did not state with particularity the specific service or services this fee covered.
  • The statement that $50 of this fee would be donated to a college fund was acceptable
