solicitation of accident victims within 30 days of the accident. It also
proposes an enclosure that be sent with all solicitations.
General information regarding the content of a letter
DR 2-101. PUBLICITY.

No false, fraudulent, misleading, deceptive, self-laudatory, or unfair
statements;

Law firm must plan on representing the clients not referring the work out;

No testimonials regarding the lawyer's capabilities;

No unverifiable claims
General information regarding the content of a letter
DR 2-101. PUBLICITY.

Must disclose how name was obtained;

Must not "personalization" in the solicitation approach;

Must not comment on the potential merits of the case;

Includes in its text and on the envelope in which mailed, in red ink and in
type no smaller than 10 point, the recital -"ADVERTISEMENT ONLY."

For civil actions, a lawyer or law firm shall verify that the party has been
served with notice of the action filed against that party;

If the solicitation is for accident or disaster then a copy of "UNDERSTNDING
YOUR RIGHTS" must be included in the soliciation
Ethic Opinions
- OPINION 2002-6. Attorneys may contact appellant or appellee when notice of appeal is filed to convey an interest in serving as appellate counsel.
